Yes it was opened. ;)
I got it on launch day and have since upgraded to a 60gb.
I still have the box, receipt, packing material, unopened instructions, cables, telledega, and warranty. Basically the only way to tell this thing isn't new is because the tape is off the outside of the box. I can't return it to the store because it was opened but this thing is as good as new. Adult owned, non-smoking household, probably has 10 hours use. I guarantee it works perfectly and you've got a receipt for the warranty. A local buyer is welcome to test it out before handing over money. edit: It's packaged up in the box perfectly, so you could still represent it as new if you were giving it for a gift. All it needs is a piece of tape and I could return it to the store but I thought I'd hook someone up before going ninja :p
